First, foremost leave extension letter submitted for the extension of the maternity leave for child care. The government of India amended maternity benefit act established a new law that for any establishment employing 10 or more employees can entitle its female worker for 26 weeks instead of 12 weeks. Paid leave and 12 weeks of childcare leave and this 26-weeks leave will be reduced to 12 weeks after the childbirth of the employee. This 26-weekleave is only for the first two children and for later women employee, working in an organization after completing of minimum 80 days if the service is eligible for claiming the maternity benefit under the maternity benefit act. Paid leave of 12weeks in a working day or a minimum of 6 weeks of leave is entitled to a female employee.

Childcare leave application is to be applied and submitted separately for 4 weeks of extended paid leave for childcare after the delivery of the child. Further 4 weeks of paid leave can be availed if in case of delivery complications. For this employee needs to apply for maternity leave extension letter. To apply for the maternity leave extension letter for baby care the employee needs obtain form 23 from local ESIC hospital and new-born childbirth certificate is compulsory to obtain form 23.

Further, if a female employee is the biological mother of surrogate child 12 weeks maternity leave for women employees for adopting that child below three months of age before the child is handed over to the commission mother. Request for leave extension letter for maternity leave must be written in an extremely formal way addressing the situation for the extension of leave.s
