As per company policy, if an employee absconds from duty without any information, then HR should try to reach him/her over phone or possible ways immediately.The next step can be that try to reach the emergency contact number such as reference number of family member or colleague number given at the time of joining.If incase,HR is not able reach the absconded employee over his emergency contact irrespective of multiple attempts then a warning letter can be issued to the employees permanent or temporary address provided at the time of joining. The letter should be served through Registered Post with Acknowledgement Due (RPAD). The letter should consider some reasonable time frame to the employee to report back.
It happens that most of the absconded employees use to contact HR after receipt of the warning letter justifying some reasons for absence from duty or their in ability to continue. In case if the employee fails to respond back to warning letter then it is permitted to send second warning letter referring about first warning letter.Though there is no response then termination of contract of employment can be served to the absconded employee. The above process is generally followed by corporates as part of the disciplinary process in corporate sector.
So, make sure that all communications such as RPAD receipts and documents should be filed safely. If the RPAD is not reached the destination then same should not be opened by HR and should be filed as it is. Because as per the legal rules of natural justice, if an employee report back in the given period of time then it may backfire in future if the employee approach labour court for unfair termination.
The employer may stop paying gratuity if an employee's services has been terminated due to his/her misbehaviour or any other violent act. Nowadays many employees are absconding from jobs exactly after credit of salary. That’s why many corporates paying the full and final settlement to employees like salary /leave encasement /LTA etc against the notice period after completing 2 months’ notice period.
